The Center for Health and Health Care in Schools (CHHCS) News Alerts -- November
14, 2005
GAO Report Cites 'Unusual' FDA Process in Plan B Denial:
The then-acting director of the Center for Drug Evaluation and Research in the
federal Food and Drug Administration, who issued a "not approvable"
decision barring over-the-counter sale of the emergency contraception drug known
as "Plan B," did so over the protests of an advisory council of FDA scientists
who had reviewed the drug and recommended it for OTC status, the Government
Accountability Office (GAO) said in a report issued today.

Supreme Court Says Complainants Have Burden of Proof in IDEA Hearings:
The United States Supreme Court ruled today that the burden of showing whether
or not an individualized education plan (IEP) offered by a school district under
the Individuals with Disabilities Education Act (IDEA) is adequate "lies where
it usually falls, upon the party seeking relief,"
whether that party is the school district or dissatisfied parents.
